In Canada everyone has the right on arrest or detention to retain and instruct counsel without delay and to be advised of that right. The law requires that police comply with this right.  It is wise to insist on this right and to be put in contact with counsel at the very first opportunity to protect your legal rights.


 

Solicitor-client privilege is a cornerstone of the lawyer client relationship and has become a fundamental right in Canada. Privilege allows lawyers and clients to communicate freely and candidly, with the expectation that these communications will remain private. This helps to ensure lawyers are fully informed and permits clients to disclose everything necessary in furtherance of their legal objectives. It is important to note the privilege belongs to the client and not the lawyer.


Lawyers charge for their professional services along with expenses and costs (known as disbursements) while working on defending your case.   


Most criminal defence lawyers can charge an hourly rate for the time spent working on your file or a flat fee for a specific service.


There is no simple answer to what it costs to retain a criminal lawyer since there are numerous factors that can come into play. The two primary factors are the lawyer’s experience and the complexity of the case. In all instances your reputation and liberty are what's at stake and these are concepts that are difficult to put a value on. In most circumstances you can expect to be asked to sign a retainer agreement and agree to a flat fee. In other cases your lawyer's compensation will be determined based upon an hourly rate.
